Jason Bring Authors Amicus Brief for GHA, GHCA, and MAG

AGG Healthcare partner Jason Bring authored an amicus (friend of the court) brief on behalf of Georgia’s three largest healthcare associations — the Georgia Hospital Association, the Georgia Health Care Association, and the Medical Association of Georgia — in a case pending before the Court of Appeals of Georgia.

In that case, a hospital is appealing a trial court order that would bar the hospital’s attorneys from meeting with its own employed physician as part of the hospital’s defense of a patient lawsuit. The trial court ruled that the HIPAA Privacy Rule prevents the hospital’s attorneys from meeting with the physician without the patient’s attorneys also being present. Though the Privacy Rule has been in effect for over two decades, this is the first order of its kind in Georgia.
