Jeff Jacobovitz Quoted in Boston Globe Article on Antitrust Issues Related to Albertsons and Kroger Merger

In an article published in the Boston Globe on October 8, 2023, Jeff Jacobovitz, AGG trial attorney and chair of the firm’s Antitrust group, was quoted discussing the antitrust issues and potential Federal Trade Commission (“FTC”) consideration related to the proposed merger between Albertsons and Kroger grocery chains, which could hinge on the purchase of over 400 Kroger stores by C&S Wholesale Grocers.

The article pointed to the U.S. grocery industry’s highly fragmented nature as support for Kroger’s case to win FTC approval of the Kroger-Albertsons deal, along with the fact that the combined chains would still control a relatively small percentage of market share.

Jeff, who previously served as an attorney in the FTC’s Bureau of Competition, suggested that, in order to win FTC approval, the FTC may require Kroger to find a strategic buyer for hundreds of stores.
