Biography

Madison is a partner in the Healthcare practice, a member of the Hospitals & Health Systems and Emerging Technologies industry teams, and a co-chair of the Women’s Initiative. Madison focuses her practice on providing regulatory and strategic counseling to clients in the healthcare, healthcare technology, and life sciences industries, with a practical, operational focus. She represents a range of clients, including hospitals, health systems, physician and other practitioner groups, post-acute providers, emerging health tech and services companies, and private equity investors.

Madison provides guidance on federal and state issues relating to health information privacy and security, including HIPAA and state privacy laws, telehealth and remote care services, and artificial intelligence; healthcare fraud and abuse laws compliance, self-disclosures and repayments; and operational contracting and regulatory diligence and counseling in healthcare transactions.

Experience

  • Counsels clients on health information compliance matters that arise in the course of operations, including analyzing permitted uses and disclosures of protected health information, negotiating operational and business associate agreements, and reviewing and revising policies and procedures.
  • Advises clients with regard to investigations and responses to data incidents, including HIPAA breaches.
  • Represents clients with regard to HIPAA-related investigations by the Office for Civil Rights.
  • Guides clients on health information management and retention, including development of record retention and destruction policies and procedures.
  • Negotiates agreements and advises clients on implementation of artificial intelligence tools and systems, including developing policies and procedures.
  • Advises clients on state and federal regulatory considerations for practicing via telemedicine, including prescribing.
  • Represents clients in compliance analyses and internal investigations, including submitting and settling resulting self-disclosures to the Centers for Medicare & Medicaid Services and the Office of Inspector General for matters involving Stark or Anti-Kickback issues.
  • Guides clients in analyzing and submitting repayments to MACs for billing and reimbursement matters.
  • Assists clients with development of compliance programs. Conducts healthcare regulatory diligence and transaction document negotiation in multiple transactions with a variety of provider types.
