Economic Development
The Economic Development Practice Team successfully guides U.S. and foreign businesses, developers, development authorities, and state and local governments through the processes critical to the location and development of new facilities, and the expansion of existing facilities. Our attorneys are especially expert in negotiating incentives related to facility location and expansion.
As we have represented both governmental entities and businesses, we understand how to assist each to achieve their goals.
For businesses, the Economic Development Practice Team is involved with the entire process of locating or expanding a facility, including:
Site selection
Site due diligence and acquisition
Negotiation of incentives and grants
Tax abatement bond transactions
Environmental and other permits, including air and water permits
Utility and power contracts
Negotiation with railroads and preparation of related agreements
Architectural, engineering and construction contracts
Financing
Entity formation, joint ventures, mergers and acquisitions
Immigration, labor and employment practices
Employee benefits
Tax planning and tax exempt for the project and infrastructure bond financing
The Economic Development Practice Team also works closely with government agencies to assist in business expansion and relocation. While working with these agencies, our team has assisted both governmental agencies and private businesses with the negotiation and documentation of economic development incentives for clients locating or expanding their business. These incentives include grants, tax credits, government road funding, low interest loans, infrastructure financing, equipment financing, reimbursement of training costs and workforce development programs.
Public Finance
The Economic Development Practice Team offers a focused public finance expertise, including tax increment financing for infrastructure, infrastructure development districts, and tax-exempt financing for so-called “exempt facilities,” as well as sophisticated financings for real estate and economic development. We represent lenders, school districts, issuers and other public sector clients. Our knowledge and experience in state and local government law gives us the insight to help companies work with public entities to achieve their goals effectively and efficiently.
Our attorneys are at the forefront of current developments in the structuring of both tax-exempt and taxable securities and have experience derived from public finance transactions, including:
